    Protection of data privacy: Your right – our obligation

    The protection of personal data is an important concern for us. Therefore, Iqony Energies GmbH processes your data in accordance with the provisions of the European Data Protection Regulation (DSGVO) and other applicable legislation on the protection of personal data and data security.

    The following information applies to our Internet presence (hereinafter referred to only as "website").     3. PURPOSES AND LEGAL BASES OF PROCESSING

    3.1 Purposes
    You can use almost the entire Internet offering of Iqony without us requiring any personal data from you. Only a few offers and services that you will find on our pages require the provision of personal data for their use.

    3.2 Legal basis
    The legal basis is our legitimate interest in publishing our own information about our company, in making our website offer attractive and usable, and in identifying and rectifying possible technical problems (Art. 6 para. 1 p. 1 lit. f) DSGVO).

    When contacting us via a contact form, you agree that the data you provide (e.g. your e-mail address, name, telephone number) will be stored by us in order to answer your questions. Your data will be deleted after processing your request (Art. 6 para. 1 p. 1 lit. a) DSGVO).
     

    4 FUNCTIONALITIES

    4.1 Registration and use of the website
    When you visit the Iqony website, technical access data is automatically recorded and evaluated by Iqony's Internet servers (web servers). However, this data cannot be assigned to a specific person; the individual user remains anonymous. Data recorded includes:

    • IP address
    • Date and time of enquiry
    • Time zone difference to Greenwich Mean Time (GMT)
    • Content of the request (concrete page)
    • Access status/HTTP status code
    • Amount of data transferred
    • Website from which the request originates
    • Browser
    • Operating system and its user interface
    • Language and version of the browser software

    4.2 Cookies
    We also use additional cookies in some areas of our website. Cookies are small data elements that an Internet server can send to your computer. Such cookies can be used to identify your computer for the duration of your visit to our website or to make it easier for you to use our internet pages. We do not use cookies to collect personal data.

    4.3 Google Analytics
    Insofar as you have given your consent, Google Analytics, a web analytics service provided by Google LLC, is used on this website. The responsible service provider in the EU is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

    Scope of processing
    Google Analytics uses cookies. These are text files that are stored on your computer and enable an analysis of your use of our websites. The information collected by means of the cookies about your use of this website is generally transferred to a Google server in the USA and stored there.

    The use includes the Universal Analytics mode of operation: through this it is possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thereby analyze the activities of a user across devices.

    We use the function 'anonymizeIP' (so-called IP masking): Due to the activation of IP anonymization on this website, your IP address will be truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

    During your stay on the Website, the following data is captured, among other things:

    • the referrer URL (via which website/advertising medium you came to this Website)

    Purposes of processing
    On behalf of the operator of this website, Google will use this information to evaluate your use of the website and compile reports on website activity. The reports provided by Google Analytics are used to analyze the performance of our application and the success of our marketing campaigns.

    Recipient
    The recipient of the data is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland as a processor. We have concluded an order processing agreement with Google for this purpose. Google LLC, based in California, USA, and, if applicable, US authorities may access the data stored by Google.

    Storage period
    The data is automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month.

    Legal basis and withdrawal of consent
    Your consent, Art.6 para.1 first sentence lit. a GDPR is a prerequisite for such processing of data. You can withdraw your consent at any time with effect for the future; to do so, you can follow the link provided under point 4.2 "Cookies".

    4.4 SalesViewer® technology
    With the SalesViewer® technology of SalesViewer® GmbH, we collect and store data for marketing, market research and optimization purposes on the basis of legitimate interests (Art. 6 para.1 lit.f DSGVO).

    As part of SalesViewer®, a javascripl-based tracking code is used on our website, with the help of which the following information (hereinafter company data) is determined as part of the process described in more detail here (https://www.salesviewer.com/en/privacy):

    • Name, origin and industry of the visiting company
    • Source/referrer of the visiting company
    • Keyword
    • Visitor behavior (e.g. (sub)pages accesses, time of access, duration of visit)

    Thus, only company information is collected and processed.

    The data stored as part of Salesviewer will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations.

    You can object to the collection and storage of data at any time with effect for the future by clicking on this link www.salesviewer.com/opt-out to prevent the collection by SalesViewer® within this website in the future. In doing so, an opt-out cookie for this website will be placed on your device. If you delete your cookies in this browser, you must click this link again.

     

    4.5 Google Ads

    Our website uses Google Ads, an online advertising service, to present targeted advertisements. Google Ads allows us to present advertisements which are tailored to your interests and needs. It does this by using cookies and similar technologies to collect information about your web activity. The information collected by these cookies on your use of our website is as a rule transmitted to a Google server in the USA and stored there.

    We use the function 'anonymizeIP' (so-called IP masking).     Purposes of processing
    On behalf of the operator of this website, Google Ads will use this information to analyze your website usage and generate reports about activity on the website. The reports provided by Google Ads are used to analyze the performance of our ads and the success of our marketing campaigns.

    Legal basis and revocation option
    Your consent under the terms of Art. 6 para. 1 sentence 1 (a) of the GDPR is necessary for this data processing. You can revoke your consent at any time with effect for the future. To do so, follow the link provided in section 4.3 “Cookies”.

    The recipient of the data is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland as a processor. We have concluded a processing agreement with Google for this purpose. Google has confirmed to us that they process your data in the European Economic Area. We cannot rule out the possibility that Google LLC, based in California, USA, and possibly US authorities, may access the data stored by Google.     You can disable the tool via the cookie settings here. The lifetime of cookies is up to 180 days (this only applies to cookies set via this website).

We have concluded a processing agreement with Microsoft for this purpose. Microsoft has confirmed to us that they process your data in the European Economic Area. We cannot rule out the possibility that Microsoft, based in Washington, USA, and possibly US authorities, may access the data stored by Microsoft.     4.7 Evalanche
    For our online marketing activities, we use the Evalanche service on our website.

    Scope of processing
    Evalanche is a tool that collects your contact information via masks, of course only with your consent, and transfers it to our CRM system. The purpose is to send you the information you ordered. We also use Evalanche for invitations to trade fairs and other events, as well as for event registration.

    To do this, you provide us with the following data via an input mask:

    • Salutation
    • Name
    • Last name
    • Company
    • E-mail
    • ZIP
    • Country

    and declare your consent to the one-time processing of this data. The information will be sent to you by mail.

    If you have consented to receive further information or a newsletter, we will also send you a confirmation request by e-mail (double opt-in). You can unsubscribe from further mailings at any time via a link in our mailings.

    Processing purposes
    Our specific contact forms allow you, as a visitor to our website, to learn more about our company, download content, and provide us with your contact information and other demographic information. Our service provider processes and stores your personal data on German servers. We use this to get in touch with you. If you consent to it, we also collect cookies for information about your interaction with our website such as downloaded documents, visited pages, date and time of retrieval ("usage data"). For this purpose, our service provider stores information for us whether and when you have filled out a form on our website, opened marketing emails and/ or downloaded documents contained therein (e.g. white papers). Furthermore, these optional cookies can be used by us to build interest profiles and statistical evaluations. In this way, we learn which of our company's services are of interest to you.

    Receiver
    The recipient of the data (service provider) is the German company SC-Networks GmbH, Würmstraße 4 82319 Starnberg, which is managed by our service provider CRM-Consults GmbH, Felsweg 14, 35435 Wettenberg and with whom we have concluded an order processing agreement.

    Insofar as you have requested the download of documents (e.g. white papers) or consented to the sending of further information, your data will also be stored in our customer database.

    Your data is stored exclusively on servers in the EU. The emails are sent via an Iqony server.

    Storage duration
    Your transaction data will be deleted no later than 4 weeks after the end of the contract for the Evalanche service. The interest profile generated from the cookies will be deleted after 24 months at the latest. Your contact data will be deleted from our CRM system after three years of passivity.

    Legal basis and revocation option
    This data processing is subject to your individual consent, Art. 6 para.1 p.1 lit. a) DSGVO. For the services selected by you, Evalanche requests a double-opt-in in accordance with data protection. You can revoke your consent at any time with effect for the future. For this purpose, we provide a link in each notification email. For more details, see chapter 6 "Your rights".

    4.8 Our Website
    We use IT and support service providers to provide the Website. These service providers are carefully selected by us and act as processors for us.

    Our hosting provider is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany.

    5. RECIPIENTS OF YOUR DATA / TRANSFER TO THIRD COUNTRIES

    The processing of your personal data generally takes place in a member state of the European Union or in another state party to the Agreement on the European Economic Area. A transfer of personal data to a third country or access to such data from a third country will only take place if the specific requirements of Art. 44 et seq. DSGVO are fulfilled (e.g. through the agreement of standard contractual clauses or insofar as the recipient acts on the basis of a legal basis which the European Commission has decided pursuant to Art. 45 (1) DSGVO (so-called adequacy decision)). For more details, please refer to the individual providers mentioned in chapter 4.

    Note: Transfer of data to the USA
    With regard to the use of analytics cookies and third-party cookies (such as Google or YouTube), data transfer to the USA cannot be ruled out. On July 10, 2023, the EU Commission decided that the transfer of personal data to the USA can be carried out in compliance with data protection regulations, provided that the US companies used have appropriate certification. Google LLC is certified under the EU-US Privacy Framework. You can find a complete overview of all certified organizations here. As not all US companies have this certification and US security authorities have extensive access powers to monitor "foreign communications", we expressly point out that data protection-compliant use cannot be guaranteed. Please bear this in mind when you give us your consent to set these cookies.

    6. YOUR RIGHTS

    You have a right of access, i.e. you can ask us to disclose all the personal information we have collected and hold for time (Article 15 of the GDPR). In addition, you may also request rectification (Art. 16 DS-GVO) or erasure (Art. 17 DS-GVO) or restriction of processing (Art. 18 DS-GVO) and have a right of appeal to a data protection supervisory authority (Art. 77 DS-GVO in conjunction with Section 19 BDSG).

    If we process your personal data on the basis of your consent, you can revoke this consent at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation, but the processing for the future ceases..

    You can address revocation and other requests to our Group Privacy Officer.

    Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time. You can inform us of your advertising objection using the following contact data: info@iqony.energy. 

    We take your inquiries and concerns very seriously and always endeavor to comply with them.

    Furthermore, you have the right to lodge a complaint with a data protection supervisory authority in accordance with Article 77 DSGVO in conjunction with Section 19 BDSG.
